1. Agreement

By placing an order with Shepherd Direct you agree to these terms. If you are ordering for a company, you confirm you have authority to bind that company.

2. What we do

We print, address, sort, and deliver direct mail to the United States Postal Service on your behalf. We also provide design services and mailing list services when you request them.

We deliver mail to USPS. We do not control USPS delivery timing, and delivery estimates are estimates, not guarantees.

3. Quotes and pricing

Prices shown on the site are current published rates and are subject to change. A quote is valid for 30 days. Postage is quoted at current USPS rates; if USPS changes rates before your job mails, the postage portion adjusts to the actual rate and we will tell you before we mail.

Sales tax is applied per Florida law based on the applicable rate for your order.

4. Proofs and approval

We send a proof before anything prints. You are responsible for reviewing it. Once you approve a proof, you accept the content as correct, including spelling, phone numbers, dates, prices, and offer terms. We are not responsible for errors that were present in an approved proof.

Production time starts when you approve, not when you order.

5. Your artwork and content

You warrant that you own or have licensed everything you send us, images, fonts, logos, copy, and any trademarks. You agree to indemnify us against any claim arising from the content of your mail piece.

We may decline any job. We will not print or mail content that is illegal, fraudulent, deceptive, defamatory, obscene, that infringes someone's rights, or that we believe would violate USPS regulations.

6. Mailing lists and compliance

If you supply a list, you warrant that you have the legal right to mail to those addresses and that the list was obtained lawfully. You are responsible for complying with all laws that apply to your mailing, which may include CAN-SPAM (for related email), the Telephone Consumer Protection Act (for related calls), FTC advertising rules, state consumer protection law, and industry-specific rules such as HIPAA for healthcare, TILA/Regulation Z for credit offers, FCRA for prescreened offers, and state insurance advertising regulations.

Political mail must include the disclaimers required by federal and Florida law. That is your responsibility; we will remind you but we do not provide legal review.

7. Print quality and color

Commercial printing has tolerances. Color may shift within industry-standard tolerance from what you see on your screen, and small variations in cutting and folding are normal. We match to industry standards, not to your monitor.

We consider quantity variances of up to 5% over or under to be a complete order; we bill on the actual quantity mailed.

8. Payment

Orders are either paid at checkout or invoiced after proof approval, depending on the option you select. Invoices are due on receipt unless we have agreed otherwise in writing. We may pause production on any account with a past-due balance.

10. Delivery timing

Production estimates run from proof approval. USPS in-home timing is outside our control. Weather, postal facility volume, and holidays affect delivery. If you have a hard date, tell us before you order and build in a buffer.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for lost profits, lost business, missed opportunities, or any indirect or consequential damages.

We make no guarantee about response rate, lead volume, or return on investment. Direct mail performance depends on your offer, your market, your list, and your follow-up, variables we do not control.

12. Confidentiality

We treat your campaign details, artwork, and lists as confidential and will not share them with your competitors or reuse them for another client.

13. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Hillsborough County, Florida.

14. Changes

We may update these terms. The version in effect when you place an order governs that order.
